General Terms and Conditions of Service

The desktop and mobile website and the Rumix.it applications (hereinafter: the “Site and App”) are owned by Rumix Srls, with registered office at Via Montebello 10, 44121 Ferrara, Italy - VAT no. 02141720389 (hereinafter: the “Owner”).

Accessing the Site and App and the information about all the services implies compliance with and acceptance of all these General Terms of Use (hereinafter: the “Terms”). For this reason, we recommend reading their content carefully if you wish to access and use the information for the purposes of the services offered by the Site and App.

User Status

Using any service offered by the Site and App (hereinafter: the “Service” or “Services”) gives the person using it the status of User (hereinafter: “User” or “Users”). In general, Users do not need to register to access the services offered by the Site and App; however, registration may be required to use some Services. Registration will take place in the manner expressly indicated in the relevant Service.

The Services offered through the Site and App are largely free of charge; however, the use of some of them is subject to payment through the purchase of paid options. Paid options (hereinafter: “Paid Options”) means the purchase by the private User of additional features specifically described in the listing publication process within the Site and App.

Any matter relating to invoicing, including changes or corrections to billing details and amounts and the issuing of credit notes, must be handled by the User by contacting the administration of Rumix Srls directly at: info@rumix.it

Minors

The use of the Services is restricted to adults only. To use the Service, minors must have previously obtained the permission of their parents, guardians or legal representatives, who will be responsible for all acts carried out through the Site and App by the minors in their care.

Permitted and Prohibited Uses

Any form of commercial exploitation of the Services, directly or indirectly, through accessing, using or transferring information contained in the Site and App is prohibited. Violation of this prohibition will be prosecuted according to law. The User acknowledges and accepts that the use of the content and/or Services offered by the Site and App is at their own exclusive risk and under their own responsibility.

The User undertakes to use the Site and App and all their content and Services in accordance with the law, morality, public order and these Terms. Likewise, the User undertakes to make appropriate use of the Services and/or content of the Site and App and not to use them for unlawful, criminal or bad-faith activities, to infringe the rights of third parties and/or intellectual property regulations, or any other rule of law.

In particular, the User undertakes not to transmit, introduce, distribute or make available to third parties any material and information (data, messages, images, audio and image files, photographs, software, etc.) that is contrary to the law, morality, public order or these Terms. Using the Site and App for purposes other than those intended by the Owner is prohibited.

Furthermore, the Owner reserves the right to deny access to the services and content of the Site and App at the sole discretion of its business policy. Likewise, it reserves the right to revoke access to its pages without notice to any User who violates the provisions of this legal information.

Intellectual Property

The Owner is the rightful owner of the Site and App, of the pages they include, and of the information or elements contained in the texts, documents, photographs, drawings, graphics, databases, software, logos, trademarks, trade names or other signs protected by intellectual or industrial property rights.

Unless expressly authorized by the Owner or by the third parties holding the corresponding rights, or unless legally permitted, the User may not reproduce, transform, modify, decompile, distribute, rent, make available to anyone or allow access, through any form of public communication, to any of the elements mentioned in the previous paragraph.

Warranties and Liability

The Owner does not guarantee continuous access to, or the correct display, download or use of, the elements and information contained in the pages of the Site and App, which may be prevented, hindered or interrupted by factors or circumstances beyond its control. The Owner is not responsible for information and other content included in third-party areas or sites accessible from the Site and App. The Owner accepts no liability for the information, content, products and services offered or provided through the Site and App by third parties or entities.

Neither the Owner nor the third-party information providers accept any liability for any damage, loss, claim or expense arising from: (i) interference, interruptions, errors, omissions, telephone failures, delays, outages or disconnections in the operation of the electronic system caused by deficiencies, errors and overloads on telecommunication lines and networks, or by any other cause beyond the Owner's control, (ii) the use of any illegal and/or malicious program, on any type of media, such as viruses or similar, (iii) improper or incorrect use of the Owner's sites, (iv) browsing security, or errors caused by a malfunctioning browser, by outdated browser versions or by obsolete hardware.

Viewing Posts/Listings

Searching for information on the Site and App and displaying listings is done through automated procedures; the Owner declines all responsibility for the quality of the results offered, their content, accuracy, truthfulness and compliance with the rules set out in these Terms.
The User may in any case report listings that are illegal, fraudulent, suspicious or that do not comply with the rules of these Terms by sending a report to the editorial team of the Site and App by email using the dedicated page

The listings on the Site and App are published by real estate agencies, construction companies, other professionals and private Users. Their publication does not imply approval or endorsement by the Owner, nor any form of guarantee by the Owner regarding their content. The Owner is therefore not responsible for the truthfulness, correctness or completeness of the aforementioned listings, nor for their compliance with privacy regulations and/or any other aspect of them.

Publishing Posts/Listings

The publication of listings is governed by these General Terms for Users.

Users may post a listing free of charge (without prejudice to the possibility of purchasing services that offer additional visibility for the listing). Listings published on the Rumix.it Site and App by Basic Users may also be visible on other sites connected to and owned by Rumix.it.

The Owner reserves the right to delete listings, permanently or temporarily, at its sole and exclusive discretion.

Privacy and Personal Data Protection

Users' personal data is processed in accordance with the applicable regulations. For more information, please read the Privacy Policy.

Security

The Owner has adopted the security measures deemed suitable to guarantee the secrecy and confidentiality of personal data, as defined by the applicable laws. For more information, please read the Privacy Policy.

Cookies

Some pages of the Site and App use cookies that are neither invasive nor harmful and contain no personal data: the only purpose of the cookies is to personalize browsing. Users can configure their browser settings to refuse cookies. For more information, please read the Privacy Policy.

Termination

The Owner reserves the right to block access to the Site and App, permanently or temporarily, at its sole and exclusive discretion. Users subject to an exclusion measure will be informed of the decision and may not subsequently attempt to access the site under a different name or through other Users.

The User will be liable for damages of any kind that the Owner or its subsidiaries may suffer, directly or indirectly, as a result of any breach of the obligations deriving from the Terms of Use concerning the use of the Site and App. Furthermore, the User will hold the Owner harmless from any penalty, claim or legal action brought by third parties, including public bodies, against the Owner, its employees or collaborators, as a result of the User's violation of third-party rights through use of the Site and App or related services contrary to these Terms.

Changes

The Owner reserves the right to make the changes it deems appropriate, and may modify, delete and add new content and/or services, as well as the way in which they are presented and located.

Duration and Termination of the Service

The free services and/or content of the Site and App may be provided indefinitely for as long as the user's account remains active; furthermore, where specified, services including Paid Options last for the period of time indicated on the page of the listing publication process within the Site and App. The Owner may unilaterally close, suspend or interrupt the provision of the Service and of the Site and App at any time and without notice.

Governing Law and Jurisdiction

Except as provided by mandatory provisions of law, the Court of Ferrara (Italy) shall have exclusive jurisdiction over any dispute concerning these Terms and the relationships governed by them.
